Description of original award (Fiscal Year 2006, $200,000)

This award is made under the FY 2006 Tribal Courts Assistance Program and it supports the development, implementation, enhancement, and continuing operation of tribal justice systems. Allowable elements under the program may include, but are not limited to: establishing a core structure for a tribal court, improving case management, training court personnel, acquiring additional equipment and/or software, enhancing prosecution and indigent defense, supporting probation diversion and alternative sentencing programs, accessing services, focusing on juvenile services and multi disciplinary protocols for child physical and sexual abuse, and structuring intertribal or tribal appellate systems.

The funds will be used to structure a Tribal Court System that will address the social problems that plague their community. This Community Court will address misdemeanor crimes such as shoplifting, drug possession, disorderly conduct, and prostitution. The Tribal Court System will collect and maintain data on a weekly basis. The data collected shall include:

' Number of cases on the court docket
' Number of new cases filed
' Type of cases filed
' Type of disposition
' Number of community service hours
' Number of jail days
' Number of referrals
' Referrals per agency
' Amount of fines and court costs

In addition, the Court shall collect the following data:

' Access to Justice
' Expedition and timeliness
' Equality, Fairness, and Integrity
' Independence and Accountability
' Public Trust and Confidence

Through the implementation of the Tribal Court System, the grantee is optimistic that it will show that the offenders will be doing community service as opposed to jail time, thereby saving the Tribal Court System the cost of incarcerating an individual.
