This document was designed to help state, local, tribal, and territorial agencies conduct a privacy, civil rights, and civil liberties audit of records within the agency’s intelligence component.
This 2015 document is an audit guidance for state, local, tribal, and territorial (SLTT) agencies, including state and major urban area fusion centers, to conduct a privacy, civil rights, and civil liberties (P/CRCL) audit of records within the agency’s intelligence component. The document stresses that P/CRCL audits are an important component of effective intelligence function management that support agency leadership in ensuring the protection of community members’ privacy, civil rights, and civil liberties in the agency’s intelligence-related activities such as intelligence collection, analysis, and dissemination. This document is organized into two sections: section one provides a series of questions to facilitates agency review of a sample of records and products for compliance with the agency’s P/CRCL policy and applicable laws, regulations, guidance, and standards; and section two includes questions to assess the extent to which the agency’s daily operations align with its P/CRCL policy and implementing procedures. This resource also includes several Appendixes, including a pre-audit planning checklist, potentially applicable federal statutes and types of state laws, general principles for developing audit-recommended actions, and a template for internal memorandum from the audit team.
